Acceptance

By clicking "Create Account", you confirm you are at least 18 years old, have the legal authority to enter this agreement, and accept these Terms and the Privacy Policy.

Your Account

You are responsible for keeping your login credentials confidential, all activity that occurs under your account, and notifying us immediately at security@niobix.com if you suspect unauthorised access.

What We Provide

Niobix grants you a limited, non-exclusive, non-transferable, revocable right to access and use the Platform for your internal business purposes. The Platform includes design and engineering analysis tools, costing and quoting workflows, report generation, collaboration and team workspace tools, and any other features made available under your subscription.

Acceptable Use

You must not use the Platform to upload malware, reverse engineer Platform components, circumvent security controls, resell or sublicense access, infringe third-party IP rights, or engage in any activity that disrupts Platform performance for other users.

Subscriptions and Payment

• Paid plans are billed in advance on monthly or annual cycles
• All fees exclude applicable taxes, added at checkout
• Failed payments result in a 7-day grace period before downgrade
• No refunds for partial billing periods

Your Data — Ownership and Licence

You own your data. You retain all intellectual property rights in any files, designs, content, or outputs you create or upload. By using the Platform, you grant Niobix a limited, royalty-free licence to process, host, and transmit your content to deliver the services you use, and to derive anonymised, aggregated insights to improve Platform tool accuracy.

Platform Availability

• Uptime: 99.9% per calendar month across all core Platform services (paid plans)
• Maintenance: Max 4 hours/month · 48-hour advance notice
• Incident Notice: Within 72 hours of confirmed security breach

Warranties and Disclaimers

All outputs, results, estimates, recommendations, and reports generated by any Platform tool are provided for informational and decision-support purposes only. They do not constitute professional engineering, legal, financial, or procurement advice. Decisions based on Platform outputs must be independently validated by qualified professionals.

Limitation of Liability

Niobix's total liability for any claim is limited to fees paid by you in the 12 months preceding the claim. Niobix is not liable for indirect, incidental, consequential, or punitive damages.

Termination

You may cancel your subscription at any time via account settings. Niobix may suspend or terminate your account immediately if you materially breach these Terms.

Governing Law

• India users: governed by the laws of India, disputes under the Arbitration and Conciliation Act, 1996
• USA users: governed by the laws of the applicable State, disputes under AAA Commercial Rules
